Terms of Service
The rules governing use of Fyber's payment platform. Read these in full before signing up.

v0.1 — pending review by Jamaica-qualified counsel before launch. These terms cover use of the Fyber merchant dashboard, hosted checkout, API, and SDKs ("Services") provided by Fyber One Limited ("Fyber", "we", "us"). By creating an account or processing a transaction through the Services, you ("Merchant", "you") agree to these terms.
1. The Services
Fyber provides a payment processing platform that connects merchants to card networks via our acquiring partners (FAC PowerTranz and Sagicor Mastercard / MPGS). We are not a bank. We are not the seller of record for any transaction. Cardholder relationships remain with the card issuer; merchant relationships remain with you and your customers.
2. Eligibility & onboarding
To use the Services you must be a legally registered business, provide accurate KYC information (see our AML / KYC commitment), and operate in a permitted business category (see our Acceptable Use Policy). We may decline or terminate accounts at our discretion in accordance with these policies.
3. Fees
Transaction fees, subscription fees, and dispute fees are disclosed in our Pricing page and the merchant dashboard. Fees are deducted from settlement before funds reach your bank account. We will not introduce new fees without 30 days' written notice.
4. Settlement
Standard settlement is T+2 (two business days) into your linked Jamaican bank account in JMD, unless otherwise agreed in writing. Settlements may be delayed where transactions are subject to fraud review, KYC follow-up, or chargeback investigation.
5. Refunds & chargebacks
Merchants may issue refunds from the dashboard. Chargebacks follow the card network rules; see our Refund & Chargeback Policy for the full lifecycle, response timelines, fees, and ratio thresholds.
6. Data protection
Personal data is processed under our Privacy Policy. Where the Merchant is a controller and Fyber is a processor (per Jamaica's Data Protection Act 2020 or the EU GDPR), the Data Processing Agreement applies. Sub-processors are listed at Sub-processors.
7. Card data & PCI compliance
Card numbers are tokenised at capture and never stored in plaintext. Fyber maintains PCI DSS 4.0 alignment. The Merchant agrees not to attempt to retrieve, store, or transmit raw cardholder data outside the Services.
8. Service level
We target 99.9% uptime on production payment processing. Status is published at /status. Enterprise customers may have separate SLA terms in writing.
9. Termination
Either party may terminate with 30 days' notice. Fyber may suspend services immediately for AUP violations, suspected fraud, or unrecoverable risk to settlement balances. On termination you receive a final settlement after the chargeback window closes.
10. Limitation of liability
Fyber's aggregate liability for any claim arising out of or relating to these Terms is limited to fees paid by the Merchant in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.
11. Governing law
These Terms are governed by the laws of Jamaica. Disputes are resolved in the courts of Jamaica unless otherwise agreed in writing.
12. Changes
We may update these Terms with 30 days' notice via email and a banner in the dashboard. Continued use of the Services after the effective date constitutes acceptance.
